Discharge without conviction

Often we are able to seek a Discharge without Conviction outcome for our clients, depending on the seriousness of the crime.   This enables our clients to continue to work or travel without the restrictions a conviction can have on these aspects of life.

Discharge prior to Jury Verdict

In a large number of cases we have successfully applied to charges to be discharged without the need for a jury to deliver a verdict, these applications were made under section 347 of the Crimes Act and more recently under section 147 of the new Criminal Procedure. This is sometimes called a “347” or “getting the charges thrown out of court”
